Depending on the models in our fleet, we do have a minimum driver rental age of 21 or 23.
“Authorized Driver” means the renter and any additional driver listed by us on this Agreement, provided that each such person has a valid operator’s license for the type of vehicle rented and is at least 21 years of age. Authorized Drivers are the only persons permitted to operate the Vehicle.
You can use your insurance policy from your personal vehicle that you own or lease. We will verify with your insurer that your policy is active and in good standing. You are required to carry full coverage insurance to rent our vehicles (including liability, comprehensive, and collision)
The valid and collective liability insurance and personal injury protection insurance of any authorized rental or leasing driver shall be the primary coverage for the limits of liability and personal injury protection coverage required by the state in which you are insured.
Renter is taking responsibility for this rental vehicle under his/her own insurance and agrees that: (a) he/she will submit a claim to his/her insurance carrier for any damage to the rental vehicle; (b) if he/she refuses to, or fails to timely, file such an insurance claim for any such damage to the rental vehicle, then Prestige is expressly authorized to file such claim on Renter’s behalf; (c) any insurance proceeds received in relation to any insurance claim filed for damage to the rental vehicle, will be applied to pay the cost to repair the rental vehicle and any other costs or fees due under this Agreement; and (d) in the event the Renter’s insurance carrier denies coverage as all or any part of a claim for damage to the rental vehicle, or in the event the insurance proceeds received are in insufficient to pay the cost to repair the rental vehicle and any other costs or fees due under this Agreement, then Renter shall be liable for any and all unpaid cost to repair the rental vehicle and any other costs or fees due under this Agreement.
You are responsible for all damage or loss you cause to the Vehicle and to others. You agree to provide liability collision and comprehensive insurance covering you, us, and the Vehicle (collectively, the “Insurance”), and you shall provide written proof of same prior to your schedule departure date and time as set forth on the first page of this Agreement. You must: (a) report all damage to us and all accidents to us and the police as soon as you discover them and complete your incident report form; (b) provide us with a legible copy of any service of process, pleading, or notice of any kind related to an accident or other incident involving the Vehicle; and (c) cooperate in a loss investigation and in connection with any insurance claim.
You acknowledge and agree thar the Insurance provided by you shall be the primary insurance coverage with respect to any and all claims arising out of this Agreement or your use of the Vehicle.
We currently offer delivery of our rentals to a location of your choice in the Naples area. Options to pick up are currently unavailable, but will be offered in the future.
A full day rental is 24 hours, and our business hours are 9am-5pm daily. You can schedule a return appointment any time within business hours within your 24 hour rental period. We offer a 1 hour grace period from the time provided for return. If the vehicle is returned outside of this time frame, you will be subject to additional fees.
If the rental vehicle is brought back late, Renter will be charged a $250.00 late return fee to compensate Prestige for the administrative time and expense resulting from the late return. In addition to such late return fee, Renter will also be charged additional rental charges as follows (the “Holdover Rental Charges”): (a) if the vehicle is returned less than three (3) hours late, Renter shall pay 20% of the rental cost per day set forth above for each hour or portion thereof up to three (3) hours beyond the scheduled return date and time set forth above; (b) if the vehicle is returned more than three (3) hours but less than twenty-four (24) hours beyond the scheduled return date and time set forth above, Renter shall pay the full rental cost per day set forth above; and (c) if the vehicle is returned more than twenty-four (24) hours after the scheduled return date and time set forth above, Renter shall pay the full rental cost per day set forth above multiplied by the number of days or portions thereof after the scheduled return date and time that the rental vehicle is returned (i.e. at 24 hours and 1 minute, 2 full days of rental charges; at 48 hours and 1 minute, 3 full days of rental charges, etc.). The late return fee and all Holdover Rental Charges shall be deducted first from the security deposit and if the security deposit is insufficient to pay all such charges, then such charges shall be charged to the Renter’s credit card on file.
Failure to return rented vehicle and/or any optional equipment upon expiration of the rental period or failure to pay all amounts due (including costs for damage to the rented vehicle or other personal property or equipment provided by Prestige) are evidence of abandonment or refusal to redeliver the vehicle, punishable in accordance with Florida laws.
In the event of any cancellation, Renter will be responsible for a cancellation fee of $500.00 to compensate Prestige for the administrative time and expense resulting from the cancellation.
In addition to such cancellation fee, Renter will also be responsible for a portion of the estimated rental charges (the “Cancelled Rental Charges”) as follows:
(a) 25% of the estimated rental charges if canceled less than fourteen (14) days but more than seven (7) days prior to the planned departure date;
(b) 50% of the estimated rental charges if canceled less than seven (7) days but more than five (5) days prior to the planned departure date;
(c) 75% of the estimated rental charges if canceled less than five (5) days but more than three (3) days prior to the planned departure date; and
(d) 100% of the estimated rental charges if canceled less than three (3) days prior to the planned departure date.
All cancellation fees and Cancelled Rental Charges shall be deducted from Renter’s security deposit and prepaid estimated rental charges, and retained by Prestige. Any balance remaining after deduction of the cancellation fees and the Cancelled Rental Charges shall be refunded to Renter. Notwithstanding anything herein to the contrary, if Prestige is able to re-rent the vehicle to another customer for any portion of a cancelled rental period, the amount of the actual rental charges received by Prestige from re-renting the vehicle shall be credited against the Cancelled Rental Charges due from Renter, but not against the cancellation fee, which shall be due and payable in connection with any cancelled rental.
Upon booking, Renter shall provide Prestige with a $2,500 security deposit paid via credit card. Not less than fourteen (14) days prior to the departure date, Renter shall pay the full estimated rental charges via credit card. Renter acknowledges and agrees that Prestige shall keep a copy of Renter’s credit card on file and that Prestige may and is hereby authorized to charge such credit card for any charges relating to the rental in excess of the security deposit and prepaid estimated rental charges, including, but not limited to, tolls, refueling, cleaning, excess mileage, loss of use, and/or damage to the vehicle or other property or equipment provided by Prestige.
Base rental rates are based on an estimated mileage. Renter’s actual mileage may differ from estimated mileage. Actual mileage is determined by the manufacturer installed odometer. Mileage is limited to 125 miles per day. Any additional miles incurred on this rental will be charged at a rate of $3.00/mile.
Unless otherwise agreed by us in writing prior to your scheduled departure date and time as set forth on the first page of this Agreement, the Vehicle cannot leave the state of Florida.
The following uses of the Vehicle are prohibited and are material breaches of this Agreement. The Vehicle shall not be operated or used: (a) by anyone who is not an Authorized Driver, or by anyone whose driver’s or other operator’s license is suspended in any jurisdiction; (b) by anyone under the influence of prescription or non-prescription drugs or alcohol; (c) by anyone who obtained the Vehicle or extended the Rental Period by giving us false, fraudulent or misleading information, (d) in furtherance of any illegal purpose or under any circumstance that would constitute a violation of law, other than a minor traffic violation; (e) while pushing or carrying dangerous or hazardous items or illegal material in or on the vehicle; (g) outside the geographical limitations indicated elsewhere in this Agreement; (h) if the odometer has been tampered with or disconnected; (i) when the fluid levels are low, or it is otherwise reasonable to expect you to know that further operation would damage the Vehicle; (j) to commit a willful, wanton or reckless act; (k) by anyone who is sending an electronic message including (SMS) messages or emails, while operating the Vehicle; or (l) in violation of any “Rules of the Road” vehicle safety and operations training, or other similar materials that we provide to you at the time of rental.
Vehicle will be filled with only premium unleaded gasoline and will be delivered to the Renter with a full tank. If the vehicle is returned with less than a full tank, additional charges will be imposed and will be deducted first from the security deposit and if the security deposit is insufficient to pay all such charges, then such charges shall be charged to the Renter’s credit card on file.
